What Is the 9.5 Rule?

The 9.5 rule is a contractual protection that limits how many hours UPS can routinely work a package car driver. Under Article 37 of the National Master UPS Agreement, the Employer must make a reasonable effort to keep package car drivers' workdays below 9.5 hours per day for those who request it. [2]

Who Is Eligible to Opt In?

Not every driver is automatically covered. Article 37 of the National Master sets out specific eligibility requirements. You qualify if at least one of the following applies to you [2]:

What Are the Penalties? Triple Pay, Then Quadruple Pay

Step 1 — Triple Time Pay

When you're on the 9.5 list and UPS works you more than 9.5 hours on three days in a workweek, the Employer's Vice President and the Union's Co-Chair have the discretion to grant you triple time pay for every hour worked over 9.5 hours per day. [1] [2]

Step 2 — Repeat Violations Trigger an Escalation Meeting

If a driver is paid a penalty under the 9.5 provision more than four (4) times in a calendar year, the contract requires that a meeting be scheduled — within 45 days of that filing — between the District Labor Manager, Business Agent, and the Co-Chairs (or their designees) to determine what actions are necessary to ensure compliance. Step 3 — Quadruple Time Pay

If even the Co-Chairs cannot resolve it, either party may refer the matter to arbitration under Article 8. If the Union's position is sustained, the arbitrator can impose any remedy set forth in Article 37, including back wages at the appropriate rate of pay. [1]

Staffing Review Power

There's another powerful tool buried in Article 37: if the 9.5 Committee deadlocks, the Co-Chairs of the National Negotiating Committee may require a review of the adequacy of the Company's staffing in the center where the grievance was filed. If arbitration finds the excessive overtime stems from inadequate staffing, the arbitrator can award back wages equal to what affected employees would have earned as package drivers at the applicable daily guarantee versus what they actually earned — and grant appropriate progression credit. Your Right to Request Relief from Overtime (Even Without the List)

Even if you have not opted into the 9.5 list, Article 37 gives package car drivers a separate right to request overtime relief on a daily basis. The Center Manager and the Steward process those requests based on seniority, and the Employer must allow a minimum of 10% of the package car drivers worked in any Center off on a daily basis. No driver's dispatch will be adjusted more than two (2) times per month under this provision. [5]

Management Rides & Over-Supervision

UPS sometimes responds to 9.5 grievances or high-mileage concerns by putting managers in the cab. Your contract limits this, too. Generally speaking, no more than one (1) member of management may ride with a driver at any time, except for the purpose of training management personnel. A driver cannot be scheduled for more than one (1) day per year with more than one manager on the car, and that day cannot be used for disciplinary purposes. [3]

Under the National Master, the Employer must give no less than 24 hours' notice to a seniority driver prior to any ride (except post-accident/injury rides), and the notice must include the reason for the ride. Regional Variations — Check Your Supplement

The National Master sets the floor, but your Supplement, Rider, or Addendum may provide additional or different protections.

  • Western Region: Article 19, Section 1 of the Western Region of Teamsters UPS Supplemental Agreement also requires the Company to reduce overtime where requested, and allows grievances when a driver is continually worked over 9.5 hours per day.
