When Do New UPS Employees Gain Seniority? Probationary Periods Explained

By TeamstersGPT · Published June 7, 2026

Learn exactly when new UPS employees earn seniority rights under the 2023–2028 contract: probationary periods for full-time, part-time, and package car drivers explained.

If you're a new UPS employee — or thinking about becoming one — one of the most important milestones you'll hit is attaining seniority. Before that date, you have very limited job protections. After it, the full weight of the Teamsters contract kicks in. Here's exactly what the 2023–2028 National Master UPS Agreement and the Western Region Supplemental Agreement say about how and when you earn it.

Why Seniority Matters So Much at UPS

Seniority is the backbone of nearly every workplace right at UPS — from bidding on routes and shifts, to layoff order, to vacation scheduling. The Western Region Supplement makes this explicit: "The Employer recognizes that the principles of seniority shall be given prime consideration in the every day operation of the business." Article 5, Section 3 [5]

Until you attain seniority, you are a probationary employee. That status comes with a critical limitation: you can be discharged without that discharge being subject to the grievance procedure. Article 4, Section 1 [1] That means the normal Teamster protection of "just cause" does not apply to you yet. This makes understanding your probationary timeline essential from Day 1.

Full-Time Employees: The 30-Day Rule (Within 120 Days)

For new full-time employees, the rule under the Western Region Supplement is straightforward:

A new full-time employee shall attain seniority when they have worked thirty (30) days within a one hundred twenty (120) consecutive day period. Article 4, Section 1 [1]

Key points to understand:

  • The clock is measured in days worked, not calendar days. You need 30 actual working days.
  • Those 30 days must fall within a 120 consecutive calendar day window.
  • Once you hit that 30-day mark, your seniority date is backdated to your very first day worked within that 120-day period. Article 4, Section 1 [1]

That backdating matters. It means your seniority date will be earlier than the day you technically "completed" the probationary period, which can affect your standing on the seniority list relative to other new hires.

Package Car Driver New Hires: Up to 40 Days of Probation

If you are hired directly into the package car driver classification, there is a wrinkle: UPS may extend your probationary period by up to 10 additional working days at the beginning of your probation — but only if that extra time is spent entirely in classroom training. This can result in a total probationary period of up to 40 worked days within the same 120 consecutive day window. Article 4, Section 1 [1]

The intent here is to allow for structured safety and methods training before a new driver hits the road. Those extra classroom days count toward your probation total, so they are not "free" days — they are part of the qualifying window.

Part-Time to Full-Time: The 30-Day Trial Period for Package Car Drivers

If you are already a part-time UPS employee attempting to qualify as a package car driver, a different clock applies — this is called a Trial Period, not a probationary period:

  • You have 30 working days to qualify as a package car driver.
  • You may also have up to 10 additional working days at the start of the trial if those days are spent in classroom training, for a potential total of 40 working days. Article 4, Section 1 [2]

This is a meaningful distinction: you already have seniority as a part-time employee. The trial period determines whether you successfully qualify for the full-time package car classification, not whether you have any seniority at all.

Part-Time Employees: A Longer Road to Seniority

New part-time employees face a significantly longer probationary period than their full-time counterparts:

A new part-time employee shall attain seniority when they have worked seventy (70) days within a six (6) consecutive month period. Article 4, Section 1 [2]

That's more than double the full-time requirement. The same protections and limitations apply during this window:

  • You can be discharged without access to the grievance procedure before hitting 70 days. Article 4, Section 1 [2]
  • UPS cannot discharge or discipline you during probation for the purpose of evading the contract terms or discriminating against Union members — that protection applies from Day 1. Article 4, Section 1 [2]
  • Upon completion, your seniority date is backdated to your first day worked within the six-month window. Article 4, Section 1 [2]

Online member discussions confirm this variation, with UPSers noting: "The probationary period is at least 30 working days, but can be more. It's 70 working days in some regions." [10] That reflects exactly the difference between the full-time and part-time rules in the contract.

The One Protection Probationary Employees Always Have

Even before you earn seniority, the contract draws a hard line: UPS cannot fire a probationary employee as a pretext to avoid union obligations or to discriminate against union members. Article 4, Section 1 [1] [2]

This means if UPS is using the probationary period as cover for illegal discrimination or union-busting, that discharge can still be challenged. Talk to your steward immediately if you believe this is happening.

What Happens After You Attain Seniority?

Once you clear the probationary period, several things happen automatically:

  1. Your seniority date is set — backdated to your first day worked in the qualifying window. Article 4, Section 1 [1] [2]
  2. UPS must notify your Local Union of all new hires within seven (7) days of employment, providing your name, address, Social Security number, last employer, classification hired into, and date of hire. Article 4, Section 1 [2]
  3. Your name appears on the seniority list, which the employer must post at a location easily accessible to employees and update on a periodic basis. Article 5, Section 3 [5] Under the Western Region Supplement, the employer must furnish the Local Union a complete, current seniority list once per quarter. [2]
  4. You gain the right to protest the accuracy of your seniority date by filing a timely grievance if something looks wrong. Article 5, Section 3 [5]

Seasonal Employees: No Path to Seniority During Peak

If you are hired as a seasonal employee — defined under the Western Region Supplement as a full-time temporary employee hired between October 1st and December 31st — you will not accrue seniority or service credit for any purpose during that seasonal period. Article 5, Section 3 [5]

However, if you were a full-time employee before October 1st, you continue to accrue seniority normally throughout the peak season. [5]

The Local 135 Rider reinforces this principle: employees hired from October 1st through December 31st are not entitled to seniority, and any employee recalled after January 2nd is treated as a newly hired employee. Local 135 Rider 2023-2028, p. 32 [8]

How Seniority Is Lost After You Earn It

Once you have seniority, the Western Region Supplement lists the specific ways it can be terminated:

  • Discharge for cause
  • Voluntary termination (quitting)
  • Retirement
  • Failure to return within 72 hours after receiving a certified recall letter following a layoff
  • Being on layoff for 3 consecutive years (if you have 2+ years of seniority) or 2 years (if you have less than 2 years of seniority)
  • Failure to return at the expiration of an approved leave of absence

Article 4, Section 4 [5]

The Local 135 Rider adds that a 3-day no-call/no-show also breaks seniority. Local 135 Rider 2023-2028, p. 6 [7]

Pay During the Probationary Period

While you are working through your probationary period, you are already earning wages under the contract. Under the National Master Agreement, part-time employees hired or reaching seniority after August 1, 2023 start at $21.00 per hour, with a progression that increases every 12 months up to $23.00 at the 48-month mark. The start rate for part-time employees hired after August 1, 2027 will be raised to $23.00. Article 22 [3]

For part-time air driver work, the starting rate is higher — $23.00 per hour — with its own progression schedule. Article 41 [4]

Pension contributions begin for probationary employees at a reduced rate. Under the Western Region Supplement, the employer pays a contribution rate of $0.10 per hour (including $0.01 for PEER/80 for full-time employees and PEER/84 for part-time employees) during the probationary period, for no longer than the first 90 calendar days from date of hire. Once the probationary period is complete, the full standard contribution rate applies. Article 29, Section 1 [6]

Regional Variations Matter

The rules above reflect the National Master Agreement and the Western Region Supplemental Agreement. Other supplements and riders — such as the Central Region Supplement, Joint Council 28 Rider, Local 135 Rider, and others — may have their own specific language. [9] Always check your local supplement and rider, as they can modify timelines, recall procedures, and seniority-breaking events.

For example, the Local 135 Rider specifies that a laid-off employee must be given two weeks' notice of recall by registered mail, and must respond within one week or lose seniority rights — a stricter recall procedure than the Western Region's 72-hour rule. Local 135 Rider 2023-2028, p. 6 [7]

Generally speaking, the National Master sets the floor, and supplements can only improve on those terms — never take them away.

What to Do Next

If you're in your probationary period right now, keep a careful record of every day you work. Count your working days as you go. If you believe UPS is dragging out your probation improperly, or if your seniority date looks wrong after you complete the period, talk to your shop steward immediately — you have the right to file a grievance challenging the accuracy of your seniority date. Frequently asked

Can UPS fire me for any reason during my probationary period?
UPS can discharge a probationary employee without that discharge being subject to the grievance procedure — but there is one hard limit: UPS cannot fire you to evade the terms of the contract or to discriminate against union members. Article 4, Section 1 [#1] [#2] If you believe that's what's happening, contact your steward right away.
Does my seniority date start from the day I finish probation or from my first day of work?
Your seniority date is backdated to your very first day worked within the qualifying window — not the day you complete the probation. For full-time employees, that means your seniority date goes back to your first day within the 120-day period. Article 4, Section 1 [#1] For part-time employees, it goes back to the first day within the six-month window. Article 4, Section 1 [#2]
How long is the probationary period for part-time UPS employees?
Part-time employees must work 70 days within a six consecutive month period to attain seniority — significantly longer than the 30-day full-time requirement. Article 4, Section 1 [#2] Online member discussions confirm this varies by region, with some noting '70 working days in some regions.' [#10]
If I'm hired during peak season (October–December), do I earn seniority?
No. Seasonal employees hired between October 1st and December 31st do not accrue seniority or service credit during the seasonal period. Article 5, Section 3 [#5] The Local 135 Rider further specifies that any employee recalled after January 2nd is treated as a newly hired employee. Local 135 Rider 2023-2028, p. 32 [#8]
Does UPS have to tell my Local Union when I'm hired?
Yes. UPS is required to notify all Local Unions within seven (7) days of employment for all new hires, providing the employee's name, address, Social Security number, last employer, classification hired into, and date of hire. Article 4, Section 1 [#2]
